During the first lockdown possession proceedings were of course stayed. In the run up to the reopening of the courts there was much talk of a pre-action protocol in relation to possession proceedings. Whilst there were new rules undera temporary Practice Direction 55C such as the reactivation notices and the requirement to supply what may be called a Coronavirus impact assessment andthe requirement to give rent statements no pre-action protocol was ever published.
