Rent Arrears Enforcement – Third Party Debt Orders

Third Party Debt Orders

This is an order that freezes funds in the tenant’s bank/building society account. The money owed is then paid to you from this account. It must be an account in the tenant’s sole name or a joint account if Judgment has been obtained against both named account holders.

Third Party Debt Orders

This is an order that freezes funds in the tenant’s bank/building society account. The money owed is then paid to you from this account. It must be an account in the tenant’s sole name or a joint account if Judgment has been obtained against both named account holders.

This is only an option if you know the details of your tenants bank/building society and are confident that they are in credit. If the account is overdrawn when the order is sent you will not be paid. Also a tenant will know such an order has been made and will probably stop paying into that account.

Read guidance notes EX325 and complete and file with the court, form N349. These are both available from your local County Court or http://www.hmcourts-service.gov.uk/
